Make It Make Sense (the "Service") is operated by Michael Lloyd Tyree ("we", "us", "our"). By creating an account, subscribing, or otherwise using the Service, you enter into an agreement with Michael Lloyd Tyree and agree to these terms. If you do not agree, please stop using the Service.
1. The service
Make It Make Sense is an online writing tool that reviews text you submit and suggests corrections for spelling, grammar, punctuation, wrong-word usage and clarity, and lets you record intentional spellings so they are respected throughout your manuscript. Suggestions are advisory only; you decide what to accept.
2. Your account
You must be of legal age to form a binding contract, or have authority to bind the organisation you represent. You agree to provide accurate information, keep it up to date, keep your login credentials confidential, and accept responsibility for activity under your account.
3. Acceptable use
You must not:
- use the Service for any unlawful purpose, or for fraud, spam or harassment;
- submit content you do not have the rights to use, or that infringes anyone's intellectual property or privacy;
- upload malware, probe or interfere with the security of the Service, or scrape, overload or reverse engineer it;
- resell, redistribute or share access to the Service, or circumvent usage limits;
- attempt to bypass content filters or use the Service to generate illegal, hateful, deceptive or harmful material.
4. Your content and automated review
You keep ownership of the text you submit and of the corrected result. You grant us a limited licence to host and process your text solely to provide the review and to operate the Service. You are responsible for what you submit, for verifying the accuracy of any suggestion before using it, and for holding the rights to the material you paste in.
Reviews are produced with automated language models. They can be incomplete or wrong, and they are not a substitute for professional legal, medical, financial or other regulated advice. Always review output before publishing.
If you believe content processed through the Service infringes your rights, contact us and we will investigate and act where appropriate. We may remove or restrict content, refuse or filter output, and suspend accounts that repeatedly infringe.
5. Our intellectual property
We retain all rights in the Service, including its software, design, documentation and branding. You receive a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.
6. Availability
We work to keep the Service available, but we do not guarantee uninterrupted or error-free performance. Maintenance, third-party outages and other interruptions can occur.
7. Payment, subscriptions and cancellation
Paid plans renew automatically until cancelled. When you cancel, your access continues until the end of the period you have already paid for.
Payment, billing, tax, invoicing, cancellation and refund mechanics are handled by our reseller under the Paddle Buyer Terms.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
8. Suspension and termination
We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. When access ends you should export any text you wish to keep; we may delete stored data after a reasonable period.
9. Warranties and liability
To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
We are not liable for indirect, consequential or special damages, including lost profits, lost data or lost goodwill. Our total aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury where the law does not allow exclusion.
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these terms.
10. General
These terms are governed by the laws of the State of New York, United States, and the courts of that jurisdiction have exclusive jurisdiction. You may not assign this agreement without our consent; we may assign it in connection with a merger or acquisition. Neither party is responsible for delays caused by events beyond its reasonable control. We may update these terms and will post the revised version here.
